General terms and conditions of trade:

1.        Ordering:

Goods are sourced/manufactured and printed/embroidered to your instructions.

A verbal order is legally binding but you are asked to confirm your order in writing or by fax or email.

2.        Time:

Standard stock items are normally printed or embroidered and despatched within 10 days of order confirmation.

Bespoke items such as tracksuits, rugby shirts etc, are usually manufactured, printed/embroidered and despatched within eight weeks, depending on manufacturer’s own order book.

3.        Samples:

Samples which are manufactured for you and/or printed or embroidered: if no order follows, artwork, set-up, production and delivery costs will be charged.

Unprinted samples of stock items:  these must be returned at your cost and risk, or paid for.

4.        Pricing:

A guideline price list is available on request for some of the more popular styles and brands we sell, but most projects are unique and will be costed once your requirements are known.

We can provide any number from 1 up. Above 200 items discounts may be applicable depending on the pack prices and discounts available to Tacklebag from our trade suppliers.

5.        Garment Care:

Great care is taken to source the highest quality products, fabrics (garments) and materials (print and embroidery). Incorrect washing can cause damage. To get the best results follow the washing instructions. In general when colours are mixed and garments are printed & numbered - do not boil or tumble dry - do not iron on print.

6.        Faults and Returns:

Genuine faulty returns will be replaced or credited.

Goods ordered incorrectly (size/colour/print/embroidery) will not be replaced or credited.

Goods you have washed incorrectly or damaged by usage will not be replaced or credited.

We cannot guarantee exact colour matches from one order to the next as variations occur in dye batches.

7.        Disks and Screens

All embroidery disks, screens & artwork remain the property of Tacklebag, unless supplied by you.

8.        Delivery:

Delivery will be made as soon as possible after your order is ready for despatch, and to the address you give us for delivery at the time you make your order.

You will become the owner of the goods you have ordered when they have been delivered to you and you have paid for them.  Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Delivery charges: 24-hour service: £20 per box, express service by arrangement. Orders over £500 no delivery charge

Any shortage or non-delivery must be notified in writing within seven days.

9.        Accounts

All prices subject to confirmation when you order.

New clients: 50% of invoice amount payable on order, and balance on delivery.

Accounts can be set up by application. Goods will not be dispatched on overdue accounts.

Accounts may be settled by cash or by cheque, payable to Tacklebag Limited. We accept debit  and credit cards but the latter may be subject to a surcharge to cover the charges made to us. We also accept transfers by BACS or other electronic means

10.    Retention of Title:

Until full payment has been made the goods remain the property of Tacklebag and we reserve the right to withhold delivery or to reclaim the goods in the event of non-payment

11.    VAT

All adult sizes and some larger children's sizes are subject to standard rate Value Added Tax.

12.    Cancellation by you

To cancel your contract you must notify us in writing.

You cannot cancel your contract if the goods you have ordered have been printed or embroidered or manufactured specifically for you.

If we have already despatched goods to you, you must send them back to us at your own cost and risk.  If we return stock items to wholesalers, we will pass on any re-stocking charge.

 

13.    Cancellation by us

We reserve the right to cancel the contract between us if we cannot obtain the stock to fulfil your order

If we do cancel your contract we will notify you by email and will re-credit to your account any sum received by us from you as soon as possible but in any event within 30 days.  We will not be obliged to offer any additional compensation for disappointment suffered.

14.    Liability

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing within 7 working days of the delivery of the goods in question.

If you do not receive goods ordered by you we shall have no liability to you unless you notify us in writing within 7 days of the date on which we advised they would be despatched. 

Our only obligation will be, at your option:

  • to make good any shortage or non-delivery;

  • to replace or repair any goods that are damaged or defective; or

  • to refund to you the amount paid by you for any goods that are damaged or defective

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses, and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

15.    Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
